The Principal Financial Group Foundation, Inc. Awards Grants in Phoenix Area; Funds Will Support Local Art and Culture Programs

PHOENIX ARIZONA Dec. 21, 2005--The Principal Financial Group Foundation Inc., in support of community needs in the Phoenix area, provided a grant totaling $1,450 during the third quarter to the Phoenix Symphony. This grant will support the Symphony Connections music program, which aims to make the arts more accessible by engaging college students, faculty, staff and community members from surrounding neighborhoods.


"By supporting art-related educational and cultural outreach programs, The Principal is able to bring a variety of diverse cultural elements to communities where they may otherwise not be available," said Libby Jacobs, community relations director, the Principal Financial Group(R). "Providing these funds to organizations across the nation, ultimately improves the communities where our employees live and work."

This grant was provided as part of the quarterly charitable grants program of the Principal Financial Group and the Principal Financial Group Foundation. The third quarter grant cycle focuses on art and culture programs offered by a variety of not-for-profit organizations in targeted communities.

Marc Scher, vice president of government affairs and information technology, Phoenix Association of REALTORS®, has been named by the mayor and City Council as chairman of the Phoenix Pride Commission.

Scher has been a member of the commission since 2001 and was chairman of the Walk of Pride Committee. The Phoenix Pride Commission was created in 1991 to foster a sense of community pride among Phoenix and Valley residents. Several of the positive programs initiated by the commission include Sunday on Central, the Points of Pride competition and the Walk of Pride program.

Prior to joining the Phoenix Association of REALTORS® in 1994, Scher was an aide for former Phoenix Mayor Paul Johnson, for whom he was a constituent advocate and spokesperson. As a representative of the mayor, he helped introduce a unique multi-city program, “The Arizona Holiday DUI Task Force,” which was a recipient of the U.S. Conference of Mayors/Century Council “Community Partnership Award.”

Scher is past legislative relations chairman of the University of Arizona, Phoenix Alumni board of directors. He also authored and lobbied the passage of Arizona H.B. 2226 re. Small Claims Court during the 1995-96 legislative session, is a former member of the Public Affairs Professionals of Arizona, served on the 2006 Phoenix Citizens’ Bond Committee Arts and Culture subcommittee and sits on the Phoenix Chamber of Commerce Transportation Committee and Airport subcommittee.

Scher earned a bachelor's degree in political science from the University of Arizona. He is married to Stephanie and has two sons, Spencer and Ethan.

Critics say iTunes-only downloads and inflexible pricing are hurting song sales

Once again, Apple's iPod is expected to be the hottest gift of the holiday season. That should be great news for the recording industry, right? After all, many of the 10 million or so new iPod owners surely will rush to Apple Computer Inc.'s (AAPL ) iTunes Music Store to load up on songs.

Not necessarily. As has been true since the start, iPod owners mostly fill up their players from their own CD collections or swipe tunes from file-sharing sites. Now legal downloads may be losing their luster. According to Nielsen SoundScan, average weekly download sales as of Nov. 27 fell 0.44% vs. the third quarter. Says independent media analyst Richard Greenfield: "We're not seeing the kind of dramatic growth we should given the surge in sales of iPods and other MP3 players."

Which brings us to a grand irony: Apple, which launched the digital music revolution, may now be holding it back. Critics say Apple's proprietary technology and its refusal to offer more ways to buy or to stray from its rigid 99 cents a song model is dampening legal sales of digital tunes.

SCOTTSDALE, Arizona Dec. 8, 2005--Actress and cultural icon Jenna Jameson is concerned that Scottsdale Mayor Mary Manross and the City Council may have been misled by "a hired gun for the religious right" who is trying to impose his beliefs on the city of Scottsdale.


Ms Jameson is part owner of Babe's Cabaret in Scottsdale that would be put out of business under a proposed change in city ordinances governing "sexually oriented businesses." Ms Jameson said Manross used city funds to employ Scott Bergthold, "a well-known hired gun for the religious right to rewrite city laws and try to ram through an unconstitutional ordinance that would shut down a business that has been operating peacefully and legally for over 20 years in the same location."

The Scottsdale City Council will vote December 12th on the proposed ordinance change, which would bar serving alcoholic beverages at Babe's. It also would force dancers -- even if they are almost completely covered -- to perform on an elevated stage no closer than six feet from patrons and it will effectively bar the lap dances that are a popular feature of adult nightclubs.

Bergthold is a Chattanooga attorney who drafts and defends municipal adult-business regulations around the country. He is said to be the director of the Community Defense Counsel, an organization reportedly sponsored by the Alliance Defense Fund, a Christian legal firm established by more than 30 Christian ministries to help defend "family values" and work against the American Civil Liberties Union.

Ms Jameson issued the following statement:

"Mayor Manross and the council have been misled by a small but vocal group of moralists who want to impose their beliefs on the city of Scottsdale. City funds were used to employ a Tennessee lawyer named Scott Bergthold, a well-known hired gun for the religious right, to rewrite city laws and try to ram through an unconstitutional ordinance that would shut down a business that has been operating peacefully and legally for over 20 years in the same location. Bergthold's proposal for Scottsdale is also in direct conflict with Arizona State law. Courts have rejected his narrow idea of free speech rights and inevitably his proposals will meet the same fate here, too. In embracing the Bergthold crusade, Mayor Manross has seized on my fame as an entertainer and author to launch a politically motivated campaign against strip clubs. We intend to fight this form of censorship to protect our First Amendment rights.

"Whatever their moral beliefs, I think most Americans cherish the knowledge that the First Amendment to the U.S. Constitution protects freedom of speech and expression when they are being practiced legally. Erotic dancing has been declared a legal form of artistic expression in court after court, including the U.S. Supreme Court. Whether you want to watch erotic dances or not is entirely up to you, but no one has the right to impose their own narrow moralism on the rest of us, and that is exactly what Mr. Bergthold is advising Mayor Manross to do. I urge everyone who cares about our freedoms to join me at Scottsdale City Hall on December 12th at 5 pm to show the City Council and the mayor that we care about the Constitution and we don't want to be pushed around when it comes to our freedoms."
